1. Acceptance of Terms

By accessing or using Dubify.studio (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not access or use our Service. Dubify.studio provides AI-powered video dubbing and translation services. These Terms govern your access to and use of the Service, including any content, functionality, and services offered through dubify.studio.

2. Description of Service

Dubify.studio is an AI-powered platform that enables users to dub, translate, and localize video content into multiple languages using voice synthesis, voice cloning, and optional lip-sync technology. The Service operates on a credit-based system and is available under FREE, PRO, and ENTERPRISE subscription tiers. Features and processing limits vary by plan.

3. Eligibility

You must be at least 18 years of age to use the Service independently. If you are under 18, you may only use the Service under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. User Account & Security

To access certain features of the Service, you must create an account using Google OAuth. You are solely responsible for all activity that occurs under your account and must maintain the confidentiality of your login credentials. You agree to:

Provide accurate and complete information when creating your account.
Immediately notify us at support@dubify.studio of any unauthorized use of your account or any other security breach.
Not share your account credentials with any third party.
Not create multiple accounts to circumvent credit limits or plan restrictions.

Dubify.studio will not be liable for any loss or damage arising from your failure to comply with these security obligations.

5. User Content Rights

You retain all ownership rights to the video and audio content you upload to our platform ("User Content"). By uploading User Content, you grant Dubify.studio a limited, worldwide, non-exclusive, royalty-free license to process, transcode, store, reproduce, and modify the User Content solely for the purpose of providing the Service to you. This license terminates when your User Content is deleted from our systems.

You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to upload your User Content and to grant the license described above. You further represent that your User Content does not infringe any third-party intellectual property rights, privacy rights, or any applicable laws.

6. Prohibited Activities

You agree not to use the Service to upload, process, or distribute content that:

Is unlawful, harmful, threatening, abusive, defamatory, or obscene.
Infringes the intellectual property, privacy, or other rights of any third party.
Constitutes non-consensual synthetic media (deepfakes) of real individuals.
Is used to spread misinformation, disinformation, or propaganda.
Violates any applicable local, national, or international law or regulation.

You further agree not to: reverse-engineer, decompile, or disassemble any part of the Service; resell or redistribute access to the Service without authorization; use the Service in any manner that could reasonably be deemed to compete with Dubify.studio's business; or use automated means to access the Service in excess of normal usage patterns.

7. Credits and Billing

The Service operates on a credit-based system. Credits are purchased and consumed when you process videos. The number of credits required for a job depends on the duration of your video and the features you enable. Enabling Lip-Sync consumes more credits than standard dubbing.

Short videos: Very short videos may be subject to a minimum credit charge. The exact credit cost for any job is displayed before you confirm submission, so you always know what will be deducted before you proceed.

Credit deduction: Credits are deducted when a job is submitted. If a job fails due to an error on our side, credits are automatically refunded to your account. Credits are non-transferable, cannot be exchanged for cash, and have no monetary value outside of the Service.

Current credit pricing and plan inclusions are available on the Pricing page. We reserve the right to adjust credit pricing with reasonable advance notice.

8. Refunds and Cancellations

Credit purchases are generally non-refundable. If you believe you have been charged in error or experienced a service failure that was not automatically remedied, you may submit a refund request to support@dubify.studio within 7 days of the charge, providing relevant documentation.

Subscription cancellations take effect immediately. No refunds are issued for the current billing period upon cancellation. You will retain access to your plan's features until the end of the paid period.

9. Intellectual Property

The Service, including its underlying technology, models, design, software, trademarks, and all related content, is the exclusive property of Dubify.studio and its licensors, and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to the Service beyond the limited license to use it as described herein.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Dubify.studio does not warrant that the Service will be uninterrupted, error-free, or that dubbing output will meet any specific quality standard. AI-generated audio and translations may occasionally produce artifacts, mistranslations, or unexpected results.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Dubify.studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or service interruption, arising out of or related to your use of the Service. In no event shall our total aggregate liability exceed the greater of (i) INR 10,000 or (ii) the total amount paid by you for the Service in the six months preceding the event giving rise to the claim.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason. Upon termination, your right to use the Service ceases immediately and your User Content may be deleted in accordance with our data retention policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Karnataka, India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email to the address associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
